Effective January 1, 2021 – CA Family Rights Act, which previously applied to employers with 50+ employees, now applies to all employers with 5+ employees, meaning BIG changes for both 5-49 employers and 50+ employers!
Employers with 5+ employees are now required to provide up to 12 weeks of protected unpaid CFRA leave within a 12-month period and continued paid health insurance premiums. To be eligible for CFRA leave, an employee must be either full or part-time working in California, have more than 12 months (52 weeks) of service (not necessarily consecutive) and have work at least 1,250 hours in the 12 month period before the date when the leave begins.
